Trading Post Client Course Terms & Conditions
Course:
To enroll in a Trading Post course, payment in full by certified check (payable to Trading Post Financial Services Inc.), direct deposit, or cash is required. Upon receipt of full payment, Trading Post Financial Services Inc. agrees to issue (via email) one (1) username and one (1) password to access the Training Program material.
Clients have immediate access, upon confirmation of transaction, for 30 days to all online training modules, self-paced 'non-graded' quizzes, OTRs and chart services. On the 30th day from their original purchase date the client will receive a "Certificate of Achievement" and a final email outlining the following points.
- Trading Post has delivered all online training modules plus OTR and chart service access for 30 days
- The client's original purchase date
- Client's order reference/transaction number
- Authorization for client to have full access to the training modules for their future reference which may be reviewed at the client's own pace for one year from their purchase date
One Year Access Clause:
All Trading Post Financial Services training program clients will have access to applicable course materials through the Client Services Portal for their personal review for one year from their original date of program purchase, as a free service. Access to this free service is subject to change and Trading Post Financial Services does not make any guarantee of this free service availability for this one year period.
Trading Post Financial Services attempts to reasonably ensure the accuracy of information contained on its website and is not responsible for any loss or damage due to use of this information or the interruption of this service.
Thirty-Day Refund Policy:
Trading Post is committed to retail client satisfaction on all of its products and backs them with a Money Back Guarantee. There is a thirty (30) calendar day money back guarantee from date of purchase on Trading Post educational courses. Non-Disclosure:
The contents of all Trading Post educational materials are the property of Trading Post and/or its licensors, and are protected by copyright and other intellectual property laws. I agree not (nor may I encourage or assist others) to (a) reproduce, retransmit, disseminate, sell, distribute, reverse engineer, publish, broadcast, circulate or commercially exploit any of the Trading Post educational materials, including training lessons, trading methods or systems, forms or vendors, (b) use screen scrapers, spiders or other automatic tools to gather information from the course, or (c) upload, download, post, reproduce or distribute any information, software or other material protected by copyright or any other intellectual property right (including, without limitation, rights of publicity and privacy) without the express written consent of Trading Post. In addition, I agree I shall not use any feature of the course for any purpose that is or may be harmful to Trading Post or is unlawful, abusive, harassing, defamatory, obscene, or threatening to Trading Post and others. I may not use the course for any unlawful purpose. I shall comply with reasonable written requests by Trading Post to protect Trading Post’s and its licensors' respective contractual, statutory and common law rights in the courses. Failure to comply with any of these terms may result in immediate termination of website access without refund and payment of damages to Trading Post.
I agree to provide Trading Post with my email address and promptly to provide Trading Post with any changes to my email address. In addition, Trading Post shall be entitled, but is not obliged, to review and/or retain my electronic or other communications with Trading Post for, among other reasons, monitoring the operation and/security of the Website and your compliance with these Terms and Conditions. Information about me, including my email address, which Trading Post may obtain, shall be used in accordance with Trading Post's Privacy Policy. In no event shall Trading Post be liable for any costs, damages, expenses or any other liabilities incurred by me as a result of such activities by Trading Post.
Passwords (if any) to access the Website, or any part of it, are for my personal use only. I shall not share my password with others or allow others to use my password.
Shipping and Handling (when applicable):
Trading Post takes every measure to deliver our products in a timely, efficient manner. The Production Department prides itself on the speed and quality of its service. To help speed the delivery, please remember the following when submitting your order forms:
It is recommended that you verify that the Shipping Address is complete and correct. Trading Post’s Production Department works diligently to ensure the delivery of our product to your designated shipping address. Please note that Trading Post cannot ship its products to a Post Office box.
Trading Post reserves the right to ship via the shipping company of its choice. Shipping companies do not guarantee delivery of all packages at the same time or on the same day. There will be no deliveries on Saturday, Sunday or public holidays.
If an ordered item is out-of-stock, it will be placed on back-order and sent when Trading Post receives additional inventory.
Damaged Packages:
We strongly recommend that you do not accept damaged packages from the delivery company. Request the package be returned to Trading Post and report the damage. Please have the order number and package number available so the shipment may be replaced. Should damage be discovered afterwards or should the shipment arrive in the absence of the consignee, email Trading Post at admin@tradingpostfinancial.com within 48 hours of receipt. Trading Post will then provide a Return Authorization Number (RA#) to return the damaged products.
The RA# must be written on the outside of each package being returned. Ship the damaged product to the address indicated on the Damaged Product Claim Form.
Non-Compete:
I agree not to use any of Trading Post's courses, live training, webcast, trading chat rooms, marketing materials, compensation program, course materials, technology, print, multimedia materials and all other related materials owned by Trading Post to start or be involved with a competing direct sales business in the financial service industry.
Risk:
I have read the Risk Disclosure page on the Trading Post website at http://www.tradingpostfinancial.com/disclaimer.php that explains in more detail the risks associated with currency trading and the limitations of hypothetical trading systems and their performance results. I understand that there is no trading system or trading advice that is free from the risk of loss and that no one can guarantee profits or freedom from loss in currency trading. I understand that Trading Post cannot guarantee that I will make a profit and agree that Trading Post, its officers, employees and independent instructors, associates or consultants will not be held responsible for trading losses.
Indemnification:
I understand that Trading Post and/or any of its independent instructors, Independent Sales Representatives ("ISR"), Channel Partners, Affiliates or consultants do not endorse or encourage the trading of futures and/or options contracts. I also acknowledge that the parties providing Forex training are not Commodity Trading Advisors (CTA's) or Commodity Brokers. I hereby agree to indemnify and hold Trading Post, its officers, employees and/or any of its independent instructors, Independent Sales Representatives ("ISR"), Channel Partners, Affiliates or consultants harmless from any and all losses, costs, liabilities, or indebtedness arising from the use of any trading information, technique, method, system or vendor shared with me.
Data Feed:
I understand that I may need to maintain a data feed subscription and email address to fully benefit from the training that Trading Post provides.
Course definition:
Refers to the following courses offered by Trading Post which are: Marketing Sector Training Programs, Trader Development Programs, Charting System Courses, Execution Platform Courses and Specialty Courses. Notice of Right to Cancel
(Only complete if you wish to cancel)
I may CANCEL this contract within THIRTY (30) CALENDAR DAYS from the date of account activation. If I cancel, any property traded in, any payments made by me under the contract or sale, and any negotiable instrument executed by me will be returned, less shipping and handling, within FIFTEEN (15) CALENDAR DAYS following receipt by the seller of my cancellation notice and returned goods.
If I cancel, I must return any goods delivered to me under this contract or sale in undamaged, new and resalable condition. The return shipment of the goods is at my expense and risk. If I fail to return the goods TEN (10) CALENDAR DAYS after the date of cancellation or after the receipt date whichever comes last, then I remain liable for performance of all obligations under this contract.
To cancel this contract, a signed and dated copy of this Cancellation Notice and a copy of the original contract must be SUBMITTED AND RECEIVED by Trading Post, #310 - 885 Dunsmuir Street, Vancouver, BC V6C 1N5 Canada, NO LATER THAN MIDNIGHT (Pacific Time) of the cancellation date to 604.608.1027.
